Types of Sexual Offences

Beginning of Text Sexual Offences under the Canadian Criminal Code include several types of behavior, which include:

  • Sexual Assault (Section 271) Any type of sexual contact/touching that is committed without consent. The sexual contact/touching could be minimal or it could be significant/serious.
  • Sexual Assault by Use of Weapons, Threats, etc., (Section 272) Sexual assault using a weapon; threatening a victim or their family members; or causing bodily harm.
  • Aggravated Sexual Assault (Section 273) Severe injuries resulting from sexual assault. Aggravated sexual assault is typically defined as the most serious form of assault.
  • Sexual Exploitation (Section 153) A relationship of trust, authority or dependency exists when an adult engages in sexual activities with a minor. Examples of adults who may have this relationship with a child would include teachers, coaches, priests, etc.
  • Charges relating to children will likely be prosecuted very aggressively and if convicted for any of these crimes, there is a high likelihood you will receive a severe sentence.

Possible Consequences for Sexual Offence Charges in Ontario

Convictions for sexual offenses in Canada result in harsh penalties. The amount of time an individual will spend incarcerated and/or be required to register as a sex offender varies depending on the type of offense committed.

Most common penalties associated with convictions for sexual offenses are:

  • Imprisonment: Convictions for most types of sexual assaults (including Aggravated Sexual Assault) can result in lengthy periods of incarceration. As a matter of fact, if convicted of Aggravated Sexual Assault, you could receive a maximum penalty of Life Imprisonment.
  • The Sex Offender Registry: In many jurisdictions throughout Canada, convictions for sexual offenses require offenders to register with the Sex Offender Registry. Registration requires offenders to report to authorities at specified intervals and restricts where they can live/work.
  • Probation and Treatment Programs: Many offenders who have been convicted of sexual offenses are placed under extended supervision (probation). Conditions of their probation may include treatment programs/counseling; restrictions on their ability to interact with specific individuals; or restrictions on how much/when they can access the Internet.
  • Prohibition Orders: In many instances courts order offenders to stay away from specific locations, or have limited access to computers/devices or even people (especially when children are involved).

In addition to the above-mentioned penalties, a conviction for a sexual offense can cause substantial social/personal problems and professional consequences. These may include, but are certainly not limited to, restrictions on employment opportunities; international travel restrictions; and a permanent criminal record.

How We Defend Sexual Offence Charges

Defending oneself from sexual offense allegations is a complex process that involves knowledge of the laws, the evidence, and the potential defenses available.

Some defenses that might be applicable to sexual offenses include:

  • Consent: Where both parties have provided informed consent prior to engaging in an act, consent is generally a defense for certain types of sexual assaults. Nonetheless, there are limits to consent as it relates to ages below those that represent full capacity (the age of consent), and where one party has authority over another (position of trust).
  • Mistaken Belief Regarding Consent: There are instances where a defendant’s mistake regarding whether they believed the other party was consenting to sex could be considered a defense. It should be noted, however, the law sets very high standards for what constitutes “reasonable” and “honest,” and these must be met for the defense to succeed.
  • Identity and Alibis: Establishing that you were not at the location where the alleged crime occurred; or challenging identification by witnesses can be crucial in establishing innocence, particularly if the entire basis of the allegations is reliant upon eyewitness testimony.
  • Violation of Charter Rights: Wherever the police or other authorities involved in your investigation or arrest have breached your rights; evidence obtained under such circumstances may be deemed inadmissible. This can limit the prosecution’s ability to mount a strong case against you.

Sexual Offences Charges FAQs

YES. There are many Sexual Offense charges that can go forward for a conviction in the Province of Ontario, when there is not one (1) single eyewitness present at the time of the offense, nor will there be physical evidence (i.e. DNA). In these cases the Crown Attorney may use the statement(s), text messages, Facebook posts, etc., as well as any other communication through social media platforms; they also may obtain surveillance footage, medical evidence, as well as having the complainant testify. Most of these types of offenses are about credibility and consent. As such it is imperative that the Crown carefully reviews all available evidence.

Beginning with the question "What is consent in sexual assaults as defined by Canada's sexual assault laws?", this answer will cover the three main elements required for consent under Canadian law; voluntary, continuous, and explicit communication. Consent may never be given when an individual has been rendered unconscious, or incapacitated due to alcohol consumption. Additionally, consent is never legally valid when it is obtained through coercion via threat or force. Also, no one can legally provide consent based on their position within society (abuse of authority). Furthermore, once consent has been provided, that consent may always be revoked by either party involved throughout the entire sexual activity.

The potential exists for this to occur as certain types of sexual offense convictions are subject to mandatory registration under Canada's Sex Offender Information Registration Act. As such, a person may be required to register as a sex offender for several years with associated impacts on their ability to find work, travel, obtain housing and meet other obligations (for example; reporting).

A sexual offense allegation or conviction can result in severe, long-term ramifications outside of a criminal court. A conviction of a sexual offense could impact an individual's ability to receive or maintain professional licenses; their chances at finding employment; their immigration status; traveling abroad; their position as a volunteer; and/or their overall reputation. Many companies will perform criminal history background checks on potential employees, particularly when the employee is going to be working with minors; vulnerable adults; health care professionals; teachers; and/or people that require national security clearance.

Can a text message, post on a social media site or other digital communication be used as proof that an offense has occurred? Yes. The police will often utilize digital evidence when investigating sexual offenses. The police and courts use digital evidence (text messages, dating app communications, email communications, photos posted to social sites, cell phone records etc.) for evidence in court. Sometimes prior or subsequent digital communication can help assess credibility and/or whether there was consent.
