What is Fraud?
Fraud is defined under Section 380 of the Criminal Code as using deceit, falsehood, or other dishonest means to deprive someone of their property, money, or other valuables.
Fraud can take many forms, including:
- Credit Card Fraud: Using someone else’s credit card or card information without permission.
- Cheque Fraud: Creating or altering cheques to deceive a bank or individual.
- Mortgage Fraud: Providing false information to obtain a mortgage loan.
- Insurance Fraud: Making false claims to collect insurance payouts.
- Employee Theft or Fraud: Misappropriating funds or assets from an employer.
- Identity Theft: Using someone else’s personal information to commit fraud.
Possible Consequences for Fraud Charges in Ontario
Fraud sentences are determined by how much money is allegedly involved, and if the government decides to proceed with the case as an indictable offense (more serious) versus a summary conviction offense (less severe). Sentencing factors are also influenced by, among other things, how much money was lost from each individual victim, the complexity of the fraudulent plan, and the previous convictions of the accused. Some potential penalties for fraud offenses include:
- Jail time: If convicted of fraud exceeding $5,000, you could face jail time ranging from 14 years; conversely, if your fraud exceeds $5,000 but not $5000, you could be sentenced to up to 2 years in jail at a summary conviction trial; or up to 10 years in jail at an indictable trial.
- Fines: A judge may decide to impose a fine that corresponds to the scope of the fraudulent activity.
- Repayment to Victims: The court has the power to issue restitution orders requiring an offender to repay a victim for losses incurred due to their fraudulent activities.
- Community supervision through Probation: A court can place conditions on the offender’s community service.
How We Defend Fraud Charges
Fraud is being charged with fraud does not necessarily result in conviction. A number of defences exist based upon the specific circumstances surrounding the charge. These include:
- Lack of Intent: Fraud charges are predicated upon an element of deception and fraud. To have a successful defence, you would need to show there was no dishonesty involved at the time you made your representations and/or you did not intend to deceive.
- Mistaken Identity: The fraud scheme may involve several participants. It is possible to establish by way of evidence that you were not directly or indirectly responsible for committing the fraud scheme.
- Duress/Coercion: The prosecution may demonstrate that you committed fraud as a direct result of duress or coercion from another individual. This may provide a defence to the charge of fraud.
- Entrapment: If law enforcement officers caused you to commit fraud, then you may have a valid defence of entrapment.

Fraud Charges FAQs
In Ontario, yes. Even though the individual that is a victim in your case didn't lose money as a result of your actions; fraud charges are able to go forward. The crown can demonstrate fraudulent activity has occurred through deceitful practices, deceptive representations or by demonstrating dishonest behavior which placed someone else's finances at risk.
In most fraud investigations a great deal of documentary and electronic evidence is reviewed. Bank records, e-transfer receipts, emails, text messages, contracts, invoices, video surveillance recordings, accounting records, cell phone data and witness testimony are all common forms of evidence that police and prosecutors use to build their case. In some frauds involving more than one party (such as those involving multiple businesses) investigators will look at business-to-business transactions; investigate and report on cryptocurrency activities; and/or review forensic accounting reports.
Fraud under $5000 is generally viewed as less severe than fraud over $5000. The distinction for fraud cases is based primarily upon the value of the fraudulent activity. While both types of fraud are punishable by a criminal conviction and possible penalties (such as fines), frauds that exceed $5000 are more severe in terms of investigation length, severity of bail restrictions, potential restitution to victims, and potential prison time.
Fraud charges can result when there are misinterpretations of what the parties intended to do with their agreement or if poor business practices were used. Misunderstandings about an agreement that resulted in a failed deal, a contract dispute or accounting error could also be the reason for fraud allegations. However, the Crown has to establish that it was done intentionally beyond a reasonable doubt. As such, a criminal defence lawyer would likely consider this matter (the intent behind the conduct) to determine if this is actually a criminal act or simply a civil/commercial matter.
Yes. As a crime of dishonesty, fraud is subject to severe sanctions both in terms of a potential criminal record and in terms of how that record will reflect on an individual's future. In addition to potentially affecting one's eligibility for certain jobs within the financial services industry (e.g., banking), fraud convictions could also negatively impact immigration applications, an applicant's eligibility for security clearance, international travel (particularly travel to the U.S.) and their ability to maintain licensure for their profession.
