Results Driven Proceeds of Crime Defence Lawyers
Being charged with possession of proceeds of crime is a very serious criminal offence that could result in severe legal and financial penalties. Convictions for this offence could include imprisonment, a permanent criminal record, loss of property or money, difficulties in securing employment, restricted travel, and long-lasting harm to your reputation. If you have been investigated by law enforcement or charged with an offence related to the proceeds of crime, it is essential that you seek counsel from an experienced and knowledgeable criminal defense attorney immediately.
At Nirwal Law, we defend clients who have been charged with crimes related to the proceeds of crime across Ontario. These types of charges are often the result of lengthy investigations conducted by law enforcement agencies, which can include financial records, electronic evidence, surveillance, or connections to other criminal offences. At Nirwal Law, we work tirelessly to preserve your rights, attack the Crown’s case against you, and develop a strategic defense based on the facts of your case.
What Is Possession of Proceeds of Crime?
Generally speaking, the Criminal Code of Canada defines proceeds of crime offences as situations where a person possesses (owns), transfers, conceals, converts, or derives benefit from monies or property that were acquired during the course of committing another criminal offence.
If law enforcement believes that you knowingly possessed (owned) either property or monies that resulted from direct or indirect participation in illegal activities, then you may face charge(s) for possession of proceeds of crime.
Allegations that lead to these types of charges may include:
- Monies believed to have come from illegal means
- Vehicle(s)/property that were paid for using illegally obtained monies
- Financial transaction(s)/bank transfer(s)
- Money laundering (allegedly converting illicit monies into clean money)
- Other property associated with drug trafficking, fraud, theft, robbery, etc.
Oftentimes, the Crown must establish that the accused had knowledge of, or was wilfully blind to, the fact that the monies or property being seized came from a criminal source.
Possible Consequences for a Proceeds of Crime Offence in Ontario
Charges related to criminal proceeds are taken very seriously by the courts in Ontario. Conviction for a charge relating to criminal proceeds will have severe repercussions in terms of the potential criminal penalties you could receive, in addition to financial consequences and negative impacts to your personal life which could last a long time into your future.
Imprisonment
Criminal possession of the proceeds of crime is considered to be a serious criminal offense and therefore a person charged with this type of offense could potentially face prison time. For example, if police suspect that a large amount of money was involved in the alleged offense or if there were allegations of involvement with organized crime, fraud, drug trafficking, or money laundering, then the crown could potentially ask for a substantial jail sentence.
Confiscation of Property and Assets
In addition to charging someone under section 462.1, police may also take action against assets (cash, vehicles, etc.) and freeze or confiscate those assets as well. There are instances where police can freeze/forfeit property/assets before the individual has their day in court.
Permanent Criminal Record
As a consequence of being found guilty under s. 462.11, an individual may suffer from having a permanent criminal record.
The effects of a permanent criminal record include:
- Limitations regarding employment opportunities
- Negative implications toward obtaining professional licenses
- Barriers when applying for housing
- Potential issues with immigration status
- Restrictions regarding accessing credit or banking services
- Restrictions regarding international travel.
Specifically, there are countries (such as the U.S.A) that do not permit people who have been convicted of crimes such as those described above to enter into that country.
Probation / Strict Reporting Requirements
Depending upon the circumstances surrounding the charges and convictions made against an individual, the Court may order probation with strict reporting requirements. Some examples of these types of reporting requirements include; regular reporting requirements to police or probation officers, restrictions on using money, counseling programs and/or restrictions on contacting or associating with specific individuals.
Immigration Consequences
If an individual is not a Canadian citizen, they may face adverse immigration consequences arising out of being convicted of offenses under s. 462.12(2). These consequences may include: refusal to admit an individual into Canada as a visitor/permanent resident, revocation of permanent residence status, initiation of deportation proceedings.
How We Defend Proceeds of Crime Charges
Cases related to the proceeds of crime are generally very complicated. In addition, they require law enforcement agencies to conduct significant amounts of investigative work, including but not limited to, large-scale financial investigations, monitoring, documentation of all forms of electronic communication, obtaining search warrants, and charging documents associated with additional offences. The attorneys at Nirwal Law carefully consider each component of the prosecution’s case in order to assess the strength of their evidence and advocate on behalf of their clients’ interests.
The nature of intent and knowledge, as they relate to the crimes described in this section, are also factors considered by Nirwal Law. The government must demonstrate beyond a reasonable doubt that the person charged with the offence was aware of, or purposefully ignored, the fact that the monies or property were derived from illegal activities.
Nirwal Law carefully reviews each component of the prosecution’s case against its clients.
This includes whether enough evidence has been established to support:
- Ownership or possession of the property
- Knowledge of the crime alleged to be responsible for generating the monies or property
- An intention to hide or conceal monies or property obtained through illicit means
- A direct link between the defendant and the alleged crime
There are instances where individuals unknowingly hold or acquire property or funds which ultimately lead to them being placed under scrutiny by law enforcement.
Review of Police Conduct and Obtaining Search Warrants
It is common for investigators to use a variety of techniques in order to locate property, assets, and evidence. These include, but are not limited to, searching residences, automobiles, computer data storage systems, bank account transactions, mobile phones, and other digital devices. When carrying out such actions, police must adhere to the provisions contained within the Canadian Charter of Rights and Freedoms, which govern police powers relating to searches and seizures, arrest and detention, interrogation, and other matters.
Nirwal Law thoroughly investigates and identifies potential issues surrounding:
- Illegal searches and seizures
- Invalid search warrants
- Rights to privacy
- Denial of access to counsel
- Other improper actions taken by law enforcement officials
If Charter violations are identified, potentially relevant evidence may be deemed inadmissible at trial.
Analysis of Financial and Electronic Records
Investigations into proceeds of crime cases commonly rely upon various types of financial documentation, including but not limited to banking records, account statements, electronic correspondence, and other related materials. Nirwal Law carefully evaluates evidence in relation to establishing whether funds acquired or held by an individual originated from sources generating income through illicit means.
Some examples of analysis performed by Nirwal Law include:
- Documentation of banking transactions
- Documents relating to electronic correspondence
- Evidence collected during surveillance
- Methods used for tracking financial activity
- Credibility and reliability of witnesses
- Representation as Strategic Defense Counsel
Each defense is based upon the unique allegations made against the individual or individuals involved in a particular case. As required, Nirwal Law negotiates with prosecutors to possibly achieve reduced charges, favourable resolutions, or both. Should a negotiated resolution fail to materialize, Nirwal Law defends its clients at trial when necessary.
Due to the serious nature of charges resulting from proceeds of crime prosecutions, which could result in criminal sanctions and/or substantial monetary penalties, it is advisable to retain competent legal counsel as soon as possible after becoming aware that you are being investigated.

Robbery Offence FAQs
Yes, physical contact isn't always needed for a robbery charge. A threat, intimidation, implied force, or brandishing a firearm during an alleged theft can also lead to robbery charges even when no actual physical altercation occurred.
The police could charge each of those people with robbery if they think all of them participated in the crime or helped each other at some point. In certain situations, a person may be held criminally responsible for their actions, regardless of whether that person was actually the person who stole something.
Yes. Cases involving allegations of wearing masks, costumes or attempting to hide their identities may be looked upon as more serious by the courts and prosecutors. They may claim the defendant's actions showed planning or intent to keep from being identified.
Most robberies involve significant amounts of witness statements/identification. Identification however is not always accurate. Poor lighting, stressful situations, brief time frames for viewing, or wearing masks can make it difficult for the witnesses to give a consistent account. These factors alone can negatively impact the prosecutions case.
